Terms of Service

Effective date: July 31, 2026

These terms are an agreement between you and Juan José Islas Aparicio, operating as Muverna (“Muverna,” “we,” “us”), an individual developer based in Zapopan, Jalisco, Mexico. They apply to the Muverna iOS app and muverna.com. By creating an account or using Muverna, you agree to these terms.

This agreement is between you and Muverna only — not with Apple. Apple is not a party to this agreement, has no obligation to provide maintenance or support for the app, and is a third-party beneficiary of this agreement as described in Section 16 below.

1. What Muverna is

Muverna is an app for running small, curiosity-driven experiments on your own behavior — logging what you try, observing what happens, and reflecting on it, instead of following a fixed plan or tracking a streak. It’s built and operated by one person: Juan José Islas Aparicio.

2. Eligibility

You must be at least 13 years old to use Muverna. If you’re between 13 and 17, you need a parent or guardian’s permission before creating an account or subscribing. If you don’t meet these requirements, don’t use the app.

3. Your account

You’re responsible for the accuracy of the information you provide (nickname, email, age range) and for keeping your account secure. You’re responsible for what happens under your account. If you believe your account has been compromised, contact [email protected].

You can delete your account at any time, directly in the app. This permanently removes your account and content as described in our Privacy Policy.

4. License

Muverna grants you a personal, non-transferable, non-exclusive license to use the app on any Apple-branded device you own or control, for your own personal, non-commercial use, and in accordance with Apple’s usage rules and these terms. This license doesn’t give you ownership of the app itself, and you may not copy, modify, reverse-engineer, distribute, or create derivative works from it.

If you access the app through Family Sharing or a volume purchase, this same license extends to that use, consistent with Apple’s terms.

5. Acceptable use

You agree not to:

  • Use Muverna for anything illegal or for purposes it wasn’t designed for
  • Attempt to interfere with, disrupt, or gain unauthorized access to Muverna’s systems
  • Reverse-engineer, decompile, or extract the app’s source code
  • Use the app to harass, harm, or impersonate others
  • Circumvent the subscription or payment system

We can suspend or terminate accounts that violate these terms.

6. Subscriptions and billing

Muverna offers a free tier and a paid subscription.

Free tier: One active experiment at a time. No access to the Closure Ritual (the reflection flow that runs when you complete an experiment).

Paid subscription (“Muverna Plan”):

  • Monthly: $6.99 USD/month
  • Annual: $47.99 USD/year
  • Prices above are our USD base pricing. Apple sets the actual price shown and charged in your local currency based on your App Store region — this is not always an exact currency conversion of the USD amount, and may differ from the figures above.
  • At our discretion, a discounted first month may be offered to new subscribers at $3.99 USD. This is a promotional offer, not a standing right — we may activate, change, or discontinue it at any time, and it may not be shown to every user.
  • At our discretion, new subscribers may be offered a 14-day free trial. A payment method is required to start the trial.

How billing works:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • If you start a free trial, you won’t be charged until the trial ends — but any unused portion of the trial is forfeited the moment you’re charged for a paid subscription.
  • Your subscription automatically renews at the end of each billing period unless you turn off auto-renewal at least 24 hours before the current period ends.
  • Your account will be charged for renewal within 24 hours before the end of the current period, at the price shown at the time of purchase (unless pricing changes, which Apple will notify you of in advance where required).
  • You can manage or cancel your subscription anytime in iOS Settings → [Your Name] → Subscriptions, or from the Subscription section inside the Muverna app, which links directly there.

Refunds: All payments are processed by Apple through the App Store. Muverna does not process payments or issue refunds directly. If you believe you’re owed a refund, request it through Apple at reportaproblem.apple.com or via Settings → [Your Name] → Subscriptions on your device. Refund decisions are made by Apple according to their own policies, not by us.

Price changes: If we change subscription pricing, it will apply to new subscribers or on your next renewal, and Apple will notify you in advance as required by their policies.

7. Third-party payment processing

All purchases are handled through Apple’s In-App Purchase system. RevenueCat manages subscription status and syncs it with our systems, but does not itself process payments. We never receive or store your payment card details.

8. Your content

Your experiments, field notes, and reflections belong to you. By using Muverna, you grant us a limited license to store and process that content solely to provide the app’s functionality (syncing, displaying it back to you, generating your Discoveries and Patterns views). We don’t use your content for anything beyond operating the app for you, and we don’t sell it.

9. Intellectual property

The Muverna app, its design, brand, and underlying code belong to Juan José Islas Aparicio. Nothing in these terms transfers ownership of that to you. If you believe your intellectual property rights have been infringed by the app, contact [email protected] — we are solely responsible for investigating and resolving any such claim; Apple has no responsibility for this.

10. Disclaimer of warranties

Muverna is provided “as is.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee the app will be uninterrupted, error-free, or meet your expectations.

In the event the app fails to conform to any warranty that does apply, you may notify Apple, and Apple will refund you the purchase price for the app (this applies to the app itself, not to subscriptions, which are refunded per Section 6). Beyond that refund, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, or damages related to a warranty failure are our responsibility, not Apple’s.

11. Limitation of liability

To the maximum extent permitted by law, Muverna and Juan José Islas Aparicio will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability for any claim related to Muverna will not exceed the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability beyond what’s permitted by applicable law.

12. Your responsibility for claims

You and Muverna acknowledge that Muverna, not Apple, is responsible for addressing any claims relating to the app or your use of it — including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection or privacy law. Apple has no obligation to address these claims.

13. Legal compliance

By using Muverna, you represent that you are not located in a country subject to a U.S. government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. government list of prohibited or restricted parties.

You’re also responsible for complying with any third-party terms that apply to your use of the app — for example, your mobile carrier’s data agreement.

14. Termination

You can stop using Muverna and delete your account at any time. We may suspend or terminate your access if you violate these terms. Sections of these terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will continue to apply.

15. Governing law and dispute resolution

These terms are governed by the laws of Mexico.

Arbitration. Any dispute arising from these terms or your use of Muverna will be resolved through binding arbitration, rather than in court, except as described below. Arbitration will be conducted by a single arbitrator under the rules of the Comité de Arbitraje Jalisco of the International Chamber of Commerce Mexico (ICC México) — https://www.iccmex.mx/comision/comite-arbitraje-jalisco — seated in Zapopan, Jalisco, Mexico. The arbitrator’s decision will be final and binding, and judgment may be entered on it in any court with jurisdiction to do so. Each party is responsible for its own costs of arbitration unless the arbitrator decides otherwise.

Small-claims carve-out. Either you or Muverna may instead bring an individual claim in small-claims court (or the closest local equivalent in your jurisdiction), if the claim qualifies under that court’s rules, rather than going through arbitration.

Exceptions. Nothing here limits a right you may have under applicable consumer protection law in your own country to bring a claim through another channel, where that law doesn’t allow it to be waived.

16. Apple as a third-party beneficiary

You and Muverna acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

17. Changes to these terms

We may update these terms as the app evolves. If we make material changes, we’ll update the effective date above and notify you in the app or by email. Continued use after a change means you accept the update.
